Terms and Conditions Overview

I agree that upon placing my True HealthCare Services, LLC (True HealthCare) order and checking this confirmation box, I am accepting all of the Terms and Conditions of True HealthCare Services, and all other True HealthCare policies found online here.

I understand and agree that some items are unable to be returned, that there are exceptions as to what items are eligible for returns, and that there will be a restocking fee for many items. I understand and agree that in order to initiate a return, I must first email True Health Care services for authorization and the next steps to begin the process at returns@truehealthcareservices.com. I also understand and agree that the cost of shipping an item back to True HealthCare is my responsibility and that all returned items must be received in new condition, unopened and unused.

I will review the complete RETURN POLICY, including all other applicable policies.


Terms and Conditions

Effective as of May 5, 2023

The following terminology applies to these Terms of Use, Privacy Policy and all Policies found on the Website: “You” and “Your” refers to you, the person accessing this website and accepting the True HealthCare’s Terms and Conditions. “True HealthCare” refers to True HealthCare Services, LLC.

True HealthCare Services, LLC (“True HealthCare”) offers users the truehealthcareservices.com website, affiliated platforms, applications and online services (collectively, the “Website”), subject to the user’s acceptance of the terms, conditions, policies and notices contained in the following terms of use (the “Terms of Use”). These Terms of Use apply to your use of or visit to the Website and all functions or features of the Website, as well as all offers, sales, and purchases of products or services sold through the Website.

BY ACCESSING, BROWSING AND/OR USING THE WEBSITE, YOU AGREE TO FOLLOW AND BE BOUND BY THESE TERMS OF USE, AND REPRESENT THAT YOU ARE AT LEAST 18 YEARS OLD AND THAT YOU ARE LEGALLY ABLE TO ENTER INTO THESE TERMS OF USE AS YOUR BINDING AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS OF USE, PLEASE DO NOT USE THE WEBSITE.

Agreeing to these Terms of Use includes an agreement to our Privacy Policy, which is incorporated by reference as though fully set forth here. If there is a conflict between the Terms of Use and the Privacy Policy, the Privacy Policy shall have precedence with respect to your privacy.

These Terms of Use include an Arbitration provision that governs any disputes between you and True HealthCare. Unless you opt out by emailing info@truehealthcareservices.com, this provision makes it mandatory that the parties submit disputes which are not otherwise resolved, to a neutral third-party arbitrator for a binding decision and will eliminate your right to pursue a claim through a trial in a court by a judge or jury and substantially affect your rights, by preventing you from bringing, joining or participating in class action proceedings.

You further agree and acknowledge that certain True HealthCare products and offerings made available through the Website may be subject to additional or different terms and conditions. In the event of a conflict between the Terms of Use and any additional or different terms and conditions, the additional or different terms and conditions will govern.


Modification of These Terms of Use

True HealthCare reserves the right to modify these Terms of Use in its sole discretion from time to time, without notice to you. Any changes to the Terms of Use will be effective when posted to the Website (the effective date of the most recent Terms of Use appear at the top of these Terms of Use). We recommend reviewing the Terms of Use from time to time, because your continued use of the Website following the posting of such changes constitutes your agreement to and acceptance of these changes.

The trademarks, logos, service marks and trade names (collectively the “Trademarks”) displayed or used on the Website or on material available through the Website are our registered and unregistered Trademarks and may not be used in connection with products and/or services that are not related to, associated with, or sponsored by their rights holders that are likely to cause customer confusion, or in any manner that disparages or discredits their rights holders. All Trademarks not owned by True HealthCare that appear on the Website, if any, are the property of their respective owners. Nothing contained on the Website should be construed as granting, by implication or otherwise, any license or right to use any Trademark displayed on the Website without our written permission or the third party that may own the applicable Trademark. Your misuse of the Trademarks displayed on the Website is strictly prohibited.

True HealthCare’s policy is to suspend or terminate the account, or the right to access or use the Website or any part of the Website, of any person who posts infringing material on the Website or who provides any fraudulent or inaccurate take-down notice or counter-notice under the DMCA. However, True HealthCare does not have any obligation to do so.


Orders

If you wish to place an order for products available on the Website you may be asked to supply certain information relevant to your order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any order; and that (ii) the information you supply to us is true, correct and complete.

True HealthCare reserves the right to accept or decline your order or limit the order quantity for any reason, including but not limited to product availability, errors in the description or prices for products, or errors in your order.

If we are unable to verify or authenticate any information you provide during any ordering, purchase, sale, authentication, delivery, payment or remittance process, or any other process, or if we are no longer able to verify or authorize your card or bank account information, your purchase may be canceled, we may refuse to honor all pending and future purchases made on such accounts and/or on any online accounts associated with such accounts, and you may be prohibited from using the Websites.

Pricing; Sales, Use and Other Taxes

Unless otherwise noted, shipping and handling fees are not included in the displayed price of the product on the Website and will be added as part of your final purchase price. Sales, use, and similar taxes will be charged to you as required by law, and will be communicated to you before you place an order.


Payment - Payment Types and Payment Authorization

The Website currently uses authorize.net to process payments. Our third-party payment processors accept payments through various credit cards, including Visa, MasterCard, American Express and Discover or online payment methods such as PayPal, as detailed on the applicable payment screen. Payment cards (credit cards or debit cards) are subject to validation checks and authorization by your card issuer. The payment is deducted at that time the order is placed. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of your order.

You understand and agree not to hold True HealthCare liable for any adverse effect that applicable actions (whether intentional or unintentional) may cause to any other accounts you hold. You agree to not process stolen cards or unauthorized cards through the Website.

Although we attempt to accurately reflect product availability on the Website, True HealthCare cannot guarantee product availability, and certain products may not be available for immediate delivery.

Inaccuracies; Typographical Errors

True HealthCare will only be responsible for risk of loss or damage to a purchased product that occurs prior to delivery of the product to the designated carrier. True HealthCare does not assume title of any returned product until received by us in accordance with our RETURN POLICY.

By using the Website or any product or service sold or distributed by True HealthCare or through the Website, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of California, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and True HealthCare.


International Users

Products sold on this Website by True HealthCare can only be sold to end-users residing in the United States and not to international customers. If any of these Terms are deemed invalid, void, or for any reason unenforceable, that term will be severed and will not affect the validity and enforceability of any remaining term or condition. NOTHING IN THESE TERMS OF USE WILL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.


Assignment

You will not transfer or assign any rights or licenses granted to you pursuant to these Terms of Use, and any purported assignment or other transfer in violation of this paragraph will be null and void and of no force or effect.


No Third-Party Beneficiaries
